2. Information about our services

This site presents information about FluxCS services for the automotive industry, including quality control, sorting and inspection, resident representation, engineering and technical assistance, auditing, rework, and repair.

The scope, deliverables, timelines, prices, and responsibilities of each service will be established in the quote, proposal, or contract agreed upon by the parties.

Submitting a request for information or a quote does not, by itself, constitute the hiring of a service. These conditions do not limit the legal obligations of FluxCS or the rights of its clients.

3. Use of the site

Users must use the site lawfully and respect the rights of third parties.

Impersonation, entering fraudulent information, distributing malicious content, interfering with the operation of the site, or attempting to access accounts, systems, or restricted information without authorization is not allowed.

When using the forms, provide relevant information and avoid including personal data of third parties without the corresponding authorization or basis.

4. Intellectual property

The rights to the texts, images, logos, designs, documents, and other materials on the site belong to FluxCS or their respective owners.

Access to the site does not imply the transfer of rights over these materials. Their reproduction, distribution, or modification must have the corresponding authorization when necessary, respecting the exceptions and uses permitted by applicable legislation.

The mention of third-party brands or names does not imply, by itself, a relationship of representation, certification, or commercial endorsement.

1. Responsible for your personal data

FLUX QUALITY CONTROL, which uses the trade name FluxCS, located at Villa de la Paz 11a, Granvilla, Silao, Guanajuato, Mexico, is responsible for the processing of the personal data described in this notice.

This notice includes the data obtained through our website and the channels associated with inquiries, quotes, appointments, and initial job applications. It does not replace the specific notices corresponding to a subsequent employment relationship or other treatments.

2. Personal data we collect

According to the form and request you make, we collect:

  • Inquiries and appointments: subject, message, service of interest, requested date and time.

  • Job applications: academic background, work experience, skills, and professional data contained in your resume.

We use the necessary information to:

  • Respond to inquiries and requests for information.

  • Prepare and follow up on requested quotes or proposals.

  • Coordinate appointments, meetings, and communications related to your application.

  • Address requests related to your data and comply with applicable legal obligations.

Secondary or optional purposes

You can reject these purposes from the moment you provide your data or later, by writing to cumplimiento@fluxcs.com.mx and indicating which ones you wish to exclude. Your refusal will not affect the handling of the main application.

4. Providers and transfers

To manage the site and our communications, we use Odoo com ERP & Akky as a domain provider.

The processing carried out by providers under our instructions is distinct from transfers to third parties who receive information for their own purposes.

Data transfers: There are no data transfers to our clients.

When a transfer requires your consent, we will provide you with a mechanism to accept or reject it before carrying it out. Legal exceptions will only apply when appropriate.

5. Rights of access, rectification, cancellation, and opposition

You can request to know your data, correct it, cancel it, or oppose certain uses, in accordance with applicable legislation.

  • Your name and a means to receive the response.

  • The verification of your identity and, when applicable, your representation.

  • The right you wish to exercise and an explanation of your request.

  • The data involved, except when you request access, and elements that facilitate locating them.

  • For corrections, the requested correction and the documents that support it.

We will communicate the determination within a maximum of 20 business days from the receipt of the request. If applicable, it will be made effective within the 15 business days following. These deadlines may be extended only once for an equal period when justified.

The response and, if applicable, the delivery of information will be made via email, upon verification of identity. The exercise of these rights is free of charge, except for costs permitted by law.

6. Revocation of consent and limitation of use

You can request the revocation of your consent or limit the use or disclosure of your data by writing to cumplimiento@fluxcs.com.mx.

Indicate your name, a means of response, and the processing you wish to stop. Your identity will be verified when necessary.

The request will be addressed free of charge in accordance with the procedure and deadlines of the previous section. The revocation will not have retroactive effects. If there is a legal obligation to retain or process certain data, we will explain its scope.

The FluxCS website operates through the Odoo platform, which uses cookies for functions such as session management, security, and maintaining browsing preferences, such as language.

Cookies are small files that the browser stores on your device. Technical cookies allow certain functions of the site to operate correctly.

8. Data retention

FLUX QUALITY CONTROL will retain your data for as long as necessary to fulfill the purposes described in this notice, considering the type of request and applicable legal obligations.

Data related to inquiries, quotes, and appointments will be retained as long as necessary to address the request and the corresponding follow-up.

Job application data will be retained during the selection process and the necessary periods to address related legal responsibilities. Its retention for future vacancies will be subject to the informed purpose and the corresponding consent.

When there is a contractual relationship, the necessary information will be retained to fulfill the obligations arising from it and the applicable legal deadlines.

Once the purposes have been fulfilled and when there is no obligation justifying their retention, the data will be deleted, after blocking when applicable. During the blocking, they will be reserved to address the responsibilities that justify their retention.

9. Changes to the privacy notice

Updates to this notice will be published on this same page of the FluxCS website, indicating the date of its last modification.

The changes may respond to modifications in our services, in the data processing procedures, or in the applicable legal provisions.

When a modification requires informing you directly or obtaining new consent, we will carry out that procedure before applying the corresponding processing. The publication of a new version will not replace the consent required by law.

TERMS AND CONDITIONS



GENERAL TERMS AND CONDITIONS  For the purposes of this quotation, “FLUX QUALITY CONTROL” may be commercially identified as “FluxCS”. Any reference to THE PROVIDER, FLUX QUALITY CONTROL, or FluxCS will be understood as referring to the same service provider. 

1. SCOPE OF SERVICE The services quoted by FLUX QUALITY CONTROL will be provided based on the information, drawings, specifications, visual aids, acceptance/rejection criteria, work instructions, limit samples, and other data provided or validated by THE CLIENT. Any change in part number, criteria, inspection method, defect to be reviewed, material flow, packaging, rework, operational sequence, volume, location, shifts, service windows, or safety conditions may result in adjustments to rates, time, staffing, deliverables, and/or a new quotation. 

2. ACCEPTANCE OF THE QUOTATION This quotation will be considered accepted and binding when any of the following occurs: (i) handwritten or electronic signature of THE CLIENT; (ii) issuance of Purchase Order; (iii) acceptance via email, client portal, Odoo, or any equivalent digital means; or (iv) commencement of service by instruction or authorization of THE CLIENT. In case of discrepancy between the quotation, the Purchase Order, and any other client document, this quotation will prevail unless expressly accepted in writing by FLUX QUALITY CONTROL. 

3. PRICES All prices are expressed in local currency, unless another currency is indicated on the cover page, and are plus VAT or applicable taxes. The quoted prices consider only the scope expressly described in the commercial proposal. Special tools, measuring equipment, devices, unplanned rework, freight, storage, travel expenses, tests, special insurance, client systems, access, accreditations, extraordinary consumables, or any concept not expressly included will be quoted and invoiced separately. 

4. OPERATIONAL MINIMUMS AND BILLABLE TIMES Unless otherwise indicated on the cover page, the service will have a billable minimum of 12 hours per person per day or 48 hours per person per week and/or the weekly minimum specified in the quotation. Induction time, initial training, criteria validation, startup, setup, model changes, generation of work instructions, special reports, evidence capture, audits requested by THE CLIENT, operational meetings, and administrative closure of the project, all of the above performed by the supervisor will be billable when it is part of the service or necessary for its proper execution. 

5. DOWNTIME AND FLOW CONDITIONS The rates are calculated based on a reasonably continuous flow of material and timely access to the work area. Waiting times, stoppages, delays, or unproductivities not attributable to FLUX QUALITY CONTROL, including but not limited to: lack of material, priority changes, access delays, lack of criteria, lack of release, forklift failures, equipment, system, energy, safety, packaging quality, or any operational restriction of the site, will be billable with objective evidence and approval by THE CLIENT. 

6. OVERTIME, SUNDAYS AND HOLIDAYS Overtime hours, work on Sundays, mandatory or holiday rest will be billed according to the rate indicated on the cover page or, if not applicable, by the applicable commercial multiplier of FLUX QUALITY CONTROL. When applicable, it will charge for hours on holidays at double the rate indicated on the cover page in accordance with the current Federal Labor Law. When possible, FLUX QUALITY CONTROL will request prior authorization; however, if due to operational continuity, line protection, containment, or client instruction the service must be maintained, such hours will also be billable. 

7. CLIENT OBLIGATIONS THE CLIENT is obliged to:
a) Issue the Purchase Order and/or start-up authorization before the service begins;
b) Provide clear, current, and sufficient acceptance/rejection criteria; Send the inspection method for their parts informing their quality contact at the client's plant, if applicable. If not sent, the method will be defined by THE SUPPLIER in conjunction with the quality staff in charge of the material. If applicable. c) Provide access, a safe work area, lighting, energy, layout, materials, limit samples, and responsible contact;
d) Timely and in advance inform of any process, engineering, defect, or priority changes;
e) Validate reports, hours, and deliverables when presented to them;
f) Obtain the necessary internal authorizations to share with FLUX QUALITY CONTROL information, photographs, videos, part numbers, serials, layouts, processes, and other data required for the provision of the service. 

8. TOOLS, PPE, PER DIEM AND ADDITIONAL EXPENSES FLUX QUALITY CONTROL will provide the basic PPE and standard tools that are expressly indicated as included. Specialized equipment, calibrators, meters, fixtures, special packaging, special labeling, extraordinary transportation, lodging, meals, laundry, mileage, tolls, and other necessary expenses outside the standard will be authorized by THE CLIENT and billed additionally with a negotiable surcharge of up to 15%. When applicable, travel outside the area or service outside the standard coverage of FLUX QUALITY CONTROL will be quoted for service footprint, travel or footprint separately. 

9. REPORTS, DASHBOARDS, DIGITAL EVIDENCE, PHOTOS AND IA FLUX QUALITY CONTROL may generate and deliver physical or digital reports, boards, dashboards, photographs, videos, traceability, evidence of defects, indicators, graphs, trend reports, Pareto, Excel files, and other deliverables related to the service. THE CLIENT acknowledges and authorizes FLUX QUALITY CONTROL to use digital tools, automation, and assistive artificial intelligence to capture, classify, analyze, document, and present operational information of the project, always for the purposes of service execution, traceability, operational improvement, and generation of deliverables. The ownership of the products, parts, processes, specifications, drawings, technical information, and confidential data of THE CLIENT will remain with THE CLIENT. FLUX QUALITY CONTROL will only have a limited, non-exclusive, and revocable license to use such information during the term of the service and for purposes strictly related to its execution, support, backup, auditing, billing, tracking, and evidence. Unless expressly authorized in writing by THE CLIENT, FLUX QUALITY CONTROL will not use identifiable confidential information of the client to train public or shared artificial intelligence models. FLUX QUALITY CONTROL may use aggregated and anonymized metrics, without identifying the client or its products, exclusively for internal purposes of continuous improvement, capacity planning, internal training, and service optimization. 

10. CONFIDENTIALITY AND DATA Both parties agree to keep all technical, commercial, operational, financial, visual, or documentary information received in connection with the service confidential. Neither party will disclose such information to third parties except for operational necessity, legal compliance, or written authorization from the other party. If the service involves personal data, images of individuals, badges, screens, plates, traceable serials, audio, or any element that may be considered personal data, each party will be responsible for complying with the applicable regulations regarding the information under its control. THE CLIENT guarantees that it has the right and authorization to share with FLUX QUALITY CONTROL the information necessary for the execution of the service. 

11. SERVICE WARRANTY FLUX QUALITY CONTROL guarantees that it will provide the service with reasonably trained personnel, under current criteria and with the operational controls offered in the quotation. In the event of a quality incident directly attributable to FLUX QUALITY CONTROL, and as long as THE CLIENT is up to date with its payments, FLUX QUALITY CONTROL will prioritize the claim and, at its discretion, may:
Perform re-inspection and/or rework of the suspicious material that is still controllable. For a claim to be valid, THE CLIENT must: (a) notify it in writing within 5 business days following its detection and, in any case, no later than 60 calendar days after the service; (b) retain sufficient objective evidence; (c) allow cause analysis and access to information; and (d) not mix, transform, consume, ship, or alter the suspicious material without allowing FLUX QUALITY CONTROL its reasonable validation, except in documented urgency of containment. The warranty does not apply due to ambiguous criteria, changing criteria, unreported and quoted defects, incorrect samples, incomplete customer information, extraordinary defects, undisclosed double defects, limitations inherent to the customer's process, uncontrolled lighting conditions, ergonomics or access, subsequent repackaging, batch mixing, damage after release by third parties, or any cause not directly attributable to FLUX QUALITY CONTROL. Unless expressly agreed in writing, FLUX QUALITY CONTROL's total liability will not include indirect or consequential damages, such as lost profits, line stoppage, recall, campaign, third-party penalties, loss of production, loss of customer, or reputational damage. 

12. SECOND FILTER / ADJUSTMENT FOR COMPLEXITY OR DEFECT If during execution, complexity greater than originally reported is detected, a material increase in the defect level over 5%, new criteria, need for double filtering, clean point, additional audit, or extended containment, FLUX QUALITY CONTROL may recommend adjustments to method, timing, staffing, supervision, devices, audit frequency, or rate. If THE CLIENT decides to proceed without such adjustments, FLUX QUALITY CONTROL will not assume additional risks arising from that decision. 

13. BILLING AND PAYMENT Billing will be weekly, biweekly at most, so purchase orders must be available before the issuance of the invoice or according to the quotation cover sheet. THE CLIENT must pay within the timeframe indicated therein. Failure to pay on time will incur late interest of 3% per month on overdue balances, without prejudice to FLUX QUALITY CONTROL's right to partially or fully suspend the service when there are overdue invoices, absence of a Purchase Order, unjustified rejection of reports, or any material breach by the client. Re-billing, administrative correction, or document rework caused by issues attributable to THE CLIENT may generate additional administrative charges validated by the client. 

14. NO HIRING OF PERSONNEL During the term of the service and up to 6 months after its termination, THE CLIENT agrees not to hire directly or indirectly the operational, technical, administrative, or supervisory personnel assigned by FLUX QUALITY CONTROL, unless expressly authorized in writing. In case of breach, THE CLIENT will pay FLUX QUALITY CONTROL a replacement and transfer fee equivalent to 3 months of the integrated salary of the involved collaborator, without prejudice to other attributable damages. 

15. RELATIONSHIP BETWEEN THE PARTIES The personnel assigned by FLUX QUALITY CONTROL will depend solely and exclusively on FLUX QUALITY CONTROL. There will be no employment relationship between THE CLIENT and said personnel. THE CLIENT may not issue disciplinary or personnel management instructions directly to the collaborators of FLUX QUALITY CONTROL, and must channel any requests through the supervisor or person designated by FLUX QUALITY CONTROL. 

16. CANCELLATIONS AND SCHEDULE CHANGES The cancellation or reduction of shifts, staff, or projects with less than 24 hours' notice may incur a cancellation fee equivalent to the scheduled shift or the minimum committed cost, as applicable. Schedule changes, volume, or operational window must be notified as far in advance as possible to avoid unproductive charges. 

17. VALIDITY AND ADJUSTMENTS This quotation will be valid for the period indicated on the cover page. After this period, FLUX QUALITY CONTROL may review and update prices, coverage, times, minimums, and commercial conditions. In recurring or long-term projects, FLUX QUALITY CONTROL may adjust rates for inflation, salary increases, currency fluctuations, logistical costs, regulatory changes, site conditions, or substantial changes in scope. 

18. FORCE MAJEURE FLUX QUALITY CONTROL shall not be liable for non-compliance or delays caused by events beyond its reasonable control, including but not limited to: security events, accidents, blockades, health contingencies, widespread power or telecommunications failures, acts of authority, labor conflicts, natural disasters, or extraordinary unavailability of site access. 

19. INTEGRAL AGREEMENT This quotation constitutes the comprehensive commercial basis of the offered service. Any different or additional condition requested by THE CLIENT must be expressly accepted in writing by FLUX QUALITY CONTROL. The commencement of the service does not imply automatic acceptance of unnegotiated client terms.
